France

France was a strong performer, with six completed pledges. However 3 of France’s commitments are overdue.

Three of France’s completed pledges were to protect whistleblowers.  France’s Sapin II law includes the exoneration of criminal responsibility for disclosing public interest information under certain conditions, the opportunity for whistleblowers to seek guidance and assistance from an independent body, and criminal and civil sanctions that guard against reprisals and defamation. This legislation is ambitious.

France has also implemented an EU Directive which includes the requirement for extractive and logging companies to disclose their payments to governments, and has implemented Open Contracting and taken the principles of the Open Contracting Data Standard into account.

Three of France’s commitments are overdue. France pledged to be a full member of the EITI by the end of 2017, but as of 31 July France had not formally or publically submitted an application. France also promised to join the International Anti-Corruption Coordination Centre, which was officially launched in July 2017, but has since decided to not yet take further steps to formally participate in the Centre. Finally, the commitment to establish a public register of company beneficial ownership is also overdue. The provision had been included in the Sapin II law, but it faced a legal challenge and was suspended on July 22 2016. It was then declared unconstitutional by France’s Constitutional Court in October 2016. The pledges to join the IACCC and introduce the public register of company beneficial ownership information were both considered to be new and ambitious after the Summit.
