  • 4 Notes:

The efforts to introduce beneficial ownership legislation is ongoing in Afghanistan and the regulation has finally been approved. The last english draft included relevant points that go in the right direction to ensure information sharing with law enforcement agencies, namely the judiciary. Afghanistan underwent consultations with civil society, which was an important opportunity to fulfil this commitment. However, we have not yet viewed an english version of the law, so we are not able to assess whether the below were included from the last draft. See below the main points Included in the current draft regulation: - Easy access to information regarding beneficial ownership to judicial staff, - Managing terms and responsibilities of different agencies in regards to beneficial ownership - Prevention of corruption, financial crimes, money laundering, tax evasion, cross border and other financial crimes in the private sector - Publishing beneficial ownership of companies registered Implementation remains the final and most important step which IWA will keep monitoring.
